In these Terms, “Esenyx,” “we,” “us,” and “our” refer to the individual owner/operator of this online store. The store is hosted on Shopify, which provides the ecommerce platform and technical infrastructure for the Services.

By accessing, browsing, or using the Services (including placing an order), you agree to be bound by these Terms and by any policies referenced here (including our Return & Refund Policy and Privacy Policy). If you do not agree, do not use the Services.

1) ELIGIBILITY & ACCOUNT

To place orders or use certain features, you may need to provide personal and payment information. You represent that all information you provide is true, current, and complete and you agree to keep it updated.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Accounts are personal and non-transferable.

We make reasonable efforts to display product descriptions and images accurately. However, colors, sizes, and appearance may vary depending on your device and settings.

Prices are shown at checkout and apply at the time you place your order. Unless stated otherwise, prices may include applicable sales tax where required and will be calculated at checkout based on your shipping address.

Shipping and any additional fees are shown separately before you complete checkout.

You represent that you are authorized to use the selected payment method and that you have sufficient funds/credit.

5) SHIPPING & DELIVERY

Delivery timeframes are estimates only and are not guaranteed.

Title and risk of loss may transfer to you upon delivery, subject to applicable law and any carrier terms.

If a shipment is delayed, lost, or damaged in transit, please contact us at esenyx@hotmail.com and we will work with you to resolve the issue in accordance with our policies and applicable law.

6) RETURNS & REFUNDS

9) SHOPIFY PLATFORM

This store uses Shopify’s platform to operate the Services. However, purchases made through this store are made directly from Esenyx. Shopify is not responsible for our products, pricing, shipping, returns, refunds, or customer service.

10) REVIEWS, COMMENTS & USER CONTENT

If you submit reviews, comments, photos, videos, testimonials, or other content (“User Content”), you grant Esenyx a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, publish, translate, distribute, and display that User Content for informational, promotional, marketing, and commercial purposes, in any media.

You represent and warrant that:

  • you own or have permission to submit the User Content;

  • it does not infringe third-party rights; and

  • it is not unlawful, misleading, defamatory, obscene, or abusive.

We may remove User Content at our discretion.

16) GOVERNING LAW & DISPUTE RESOLUTION / VENUE

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles, unless your state’s consumer protection laws require otherwise.

Any dispute arising from or relating to these Terms or the Services will be brought in the state or federal courts located in Delaware, and you consent to that jurisdiction and venue—except where prohibited by applicable law (for example, certain consumer claims may be required or permitted to be brought in your state of residence).

We may update these Terms at any time. The current version will be posted on this website with the “Last Updated” date. Continued use of the Services after changes become effective means you accept the updated Terms.
